1.COMMITMENT

Every form will be reviewed and must comply with my Terms of Service. The works will be more selective, that is, the artist will choose what she would like to work with, so some works may not be accepted.

The To-Do-List is public and is sent to the customer after approval of the form.

The client will provide all necessary information and requirements upfront, including visual references or any other material before work begins. It is recommended to compile all references into one large file, be it a PDF, Google Doc, Word file, or, preferably, a Google Drive folder.

The client gives the artist non-exclusive rights to observe and replicate their character design, reference material, or any other intellectual property for use in the work.

The client guarantees the artist that any reference provided is obtained legally and with use authorized by the client.

The customer warrants that it has the authority to enter into this agreement and that it is solely responsible for decisions and approvals during the process.

The artist will endeavor to perform to the best of her abilities in good faith and warrants that the work is original to the best of her knowledge.

The artist may use commercially licensed, copyright free materials, educational materials and tools.

The artist reserves the right to refuse a work based on its content, subject matter or other reasons.

The artist decides the scope of her work, price, delivery and other project details in a proposal at the artist's discretion, which may include private messages via Discord, Twitter, Vgen, email and other platforms. Details must be agreed with the client before work begins.

The artist has no interest in any type of Image generated by Artificial Intelligence or NFTs, and the client agrees not to use the Artist's work in any of these media.

2.DEALINES AND PROCESS

The expected time of the work can be from a minimum of 2 weeks to 5 months, depending on the other works in the queue and their complexity. If you cannot wait, please do not place an order.

Works for Vtubers can take 7 months or more, depending on the waiting list.

The artist will send a sketch before payment for future changes.

The artist will voluntarily provide updates and feedback.

The client can request work in progress (WIPs) at any part of the process, as long as they avoid asking every day, interfering with the artist's work.

Quick completion work or work with deadlines will not be accepted (Negotiable). Work will line up in the queue as forms are accepted.

Files will be delivered via Google Drive, email, Vgen or similar, and can be done in PSD, PNG, SVG, JPG, and others.

If there is any delay or adjustment to the waiting time, the artist will inform the client.

3.CONTENT RESTRICTIONS

The artist will not create explicit, offensive or inappropriate content.

Specific restrictions include, but are not limited to: furries, heavy gore, armor (There are exceptions), backgrounds without characters, explicit adult content (There are exceptions), real people, elderly people, copying styles, monsters.

4.REVISIONS, CHANGES AND LIMITS

Only two general revisions are allowed during the sketch period without extra charge.

After the line art, only small revisions will be allowed, such as colours and small mistakes made by the artist.

Additional fees will be charged for excessive revisions, or even cancellation of the work.

Revisions and changes can affect progress and the waiting time.

Clients cannot edit the final work unless specified in advance during the order or with the artist's approval.

The artist limits herself to only 2 (two) drawings per client. (Negotiable).

5.COMMUNICATION

Communication should occur throughout the project, including the process, the idea, updates, updates, and more.

Means of communication may include Discord, Twitter, Trello, emails, VGen among others according to the artist's discrition.

The artist's response may vary up to a week to provide further information or updates.

The artist and client agree to discuss relevant matters related to the project. Both parties have the right to reject other topics.

If the client fails to maintain contact for an extended period, the work may be cancelled.

6.USAGE RIGHTS

By default the artist retains copyright, ownership, redistribution and intellectual property, which includes but is not limited to showing, advertising the work or work progress on websites, social media, portfolios, streaming channels and more, except when some or all rights are transferred to the customer under agreement or project specifications.

If the client wishes to cancel the commission, but the draft has already been started, the artist has the right to use his pose for any purpose.

Personal Usage Commissions don’t have any fees and can be used as profile pictures, gifts for friends, posts in personal social media, among others as long as not profitable.

Digital Commercial Usage Taxes are 50% of the full price of the commission, and are suitable for any digital commercial use such as but not limited to: promotional art, art for commercials or videos, covers for albuns, comics or novels, game sprites, Cgs, Assets, Concepts, Loading Screens Cover, Social Media banners, etc.

Merchandise Commercial Usage Taxes are 100% of the full price of the commission, and are suitable for work made into physical Merchandise, such as but not limited to: Dakimakura Pillow, keychains, mugs, posters, T-shirts, etc.

If requested by the client, the artist may provide a copyright assignment agreement for the work.

7.PAYMENT

The currently accepted payment methods are Paypal, Pix, Transfer, VGen.

Invoices, proposals or payment links will be sent to the Customer after the draft has been approved by the Customer. Clients should not submit payment until the Artist requests payment.

Invoices must be paid within 72 hours, or the project may be cancelled.

Prices are USD, depending on the currency in which the customer receives.

Prices may change or vary depending on complexity, requirements and/or additional orders.

The customer agrees that they will not ask for chargebacks and that the refund policy will be followed.

8. CANCELATTIONS AND REFUNDS

If the customer cancels the order within two days after making the payment, 50% of the price will be refunded, and the customer will be added to a list of no longer accepted customers.

No refund is possible after two days of payment, unless initiated by the artist herself or the circumstances listed below.

If the artist is unable to complete the work for any unforeseen reason, the customer may be eligible for a full refund.

If the client wishes to cancel the commission even without the possibility of a refund, the Artist will deliver the work to the client up to the point at which it was made.

9.CONFIDENTIALITY

The artist and the client agree that the information and materials offered to each party, including but not limited to personal information, technical information, marketing plans, payment information or sensitive business information, outside the development of the work, that are be visible to the public, will be considered confidential information and will not be disclosed to any other party without written permission from the owner of this information.

Work that must be private may incur a fee.

The longest deadline for a work to be posted is up to 6 months, after that the Artist has the right to display the work in any digital media.

The client's social media will not be disclosed unless the artist have their permission.

10. ACCEPTANCE

The client is over 18 years old and is legally capable of entering into an agreement or has a legal guardian who can make this agreement on their behalf.

The date of the agreement is dated according to the first interaction/communication or first transaction.
